einreiseverbot.at is a specialist practice of Brandauer Rechtsanwälte in Salzburg, a law firm that has been advising clients on legal and business matters since 1978. I have received an entry ban, what should I do first? +
Read the decision carefully, especially the instruction on legal remedies with the deadline, and gather all documents on your ties within Austria. A timely appeal to the Federal Administrative Court matters, because otherwise the decision becomes final. Call us before the deadline expires.
Do I have to travel to Salzburg for an initial consultation? +
No. We routinely offer initial consultations by video call or phone, including from abroad. The decision, the entry ban and further documents can be submitted securely online. For appointments with authorities and court hearings we are on site.
What does representation in an immigration matter cost? +
It depends on the procedure, the complexity and the instance. We discuss the fee and billing model openly at the outset, hourly or flat rate. If you have legal expense insurance, we clarify coverage directly with your insurer.
What deadlines apply to an appeal? +
Against a decision of the BFA the appeal to the Federal Administrative Court is in principle four weeks from service, against its ruling the appeal to the VwGH in principle six weeks. Because the deadlines cannot be extended, you should seek legal advice early.
Can I await the proceedings in Austria? +
That depends on the suspensive effect of your appeal. In some cases the appeal has this effect by operation of law; in others it must be granted separately or may be withdrawn. We examine and secure this question as a priority.
