Federal Administrative Court
The Federal Administrative Court (Bundesverwaltungsgericht, BVwG) is the court that hears appeals against decisions of federal authorities, including immigration matters.
The Federal Administrative Court (Bundesverwaltungsgericht, BVwG) is governed by the BVwGG and decides appeals against decisions of the Federal Office for Immigration and Asylum. In immigration cases it is the first independent court to review measures such as entry bans, return decisions and deportations.
An appeal to the BVwG must be lodged within the appeal deadline, which is four weeks from service of the BFA decision. The court can confirm, vary or set aside the decision and, where needed, decides on suspensive effect so that enforcement is paused while the case is examined.
The BVwG reviews both the facts and the law and usually holds an oral hearing. Its decision can in turn be challenged before the higher courts on points of law, the Administrative Court (VwGH) and the Constitutional Court (VfGH).
