In entry ban proceedings, the interview before the BFA is often more than a conversation. What is said and recorded can later matter for the appeal, proportionality and the authority’s threat assessment.

Section 14 AVG governs records in Austrian administrative proceedings. In practice, the key question is whether the essential answers, allegations and additions are traceable in the file.

Why the record matters later

The BVwG often looks at what was documented in the administrative file. This includes questions asked by the BFA, answers, submitted documents and references to personal ties.

If important points are missing, such as family life, employment or health, a later appeal may have to explain more. The record should therefore be treated as evidence.

What should be checked before signing

Before signing, it should be clear whether the statement was reproduced correctly. Dates, names, periods of stay, family ties and information on earlier proceedings are especially important.

A passage should not simply be accepted if it was understood differently. Corrections or additions should be stated as concretely as possible.

Using the record for the appeal

After the interview, the record can still be reviewed to identify missing or misleading points. This does not replace deadline control, but it helps structure the appeal.

A useful approach is to compare what is in the file, which evidence is missing, what conclusion the authority draws and which counterarguments can be documented.

Important: The interview record is not just a form. It can influence which facts appear settled and which points must later be actively supplemented.
