Criminal conviction and risk assessment in an entry ban is a typical intersection between an administrative decision, evidence and quick reaction. Focusing only on the words “entry ban” often misses which part of the decision must actually be challenged or supplemented.

What the legal issue is

Section 53 FPG requires an individual risk assessment. A criminal conviction can be a weighty element, but it does not replace the review of the offence, time passed, conduct since the offence, personal ties and proportionality. Criminal defence itself is not the subject of this article.

Which documents matter in practice

Useful documents include the judgment, criminal record extract, probation material, evidence of work, therapy, training, family and conduct since the offence. What matters is whether the authority genuinely processed this material in its assessment.

Practice point: The decisive element is rarely one keyword. What matters is the operative part, reasoning, service, available evidence and whether the authority properly considered the personal situation.
