Reading a BFA decision: separating return decision and entry ban orders is a typical intersection between an administrative decision, evidence and quick reaction. Focusing only on the words “entry ban” often misses which part of the decision must actually be challenged or supplemented.

Return decisions and entry bans mainly bring together sections 52 and 53 FPG. The operative part shows whether only departure was ordered, whether a duration of the entry ban was set and whether ancillary points such as voluntary departure or enforcement issues are included. The reasoning must show why the authority made these orders.

Which documents matter in practice

The full decision, proof of service, appeal information and all attachments matter. Mark each operative point separately. This shows whether the appeal should target the obligation to depart, the duration of the entry ban, the reasoning or several points at once.
