Foreign conviction and Austrian entry ban is a typical intersection between an administrative decision, evidence and quick reaction. Focusing only on the words “entry ban” often misses which part of the decision must actually be challenged or supplemented.

What the legal issue is

A foreign conviction can be relevant to section 53 FPG if the authority draws conclusions for public order or security. Still, it must classify the facts in a comprehensible way. Translations, finality, description of the offence and current circumstances must be examined separately.

Which documents matter in practice

Affected persons should keep the judgment, confirmation of finality, certified translation, criminal record extracts and material on later conduct ready. Without a clear translation it may remain unclear which facts the Austrian authority is actually using.

Practice point: The decisive element is rarely one keyword. What matters is the operative part, reasoning, service, available evidence and whether the authority properly considered the personal situation.
