A power of attorney in immigration proceedings is not just a formality. It allows legal representation, structured communication with the authority or court and quick review of file status and deadlines.

Under section 10 AVG, representation is possible in administrative proceedings unless personal appearance is expressly required. In entry ban cases, authority, service and real reachability must fit together.

What the authority practically allows

With authority, the representative can request file inspection, prepare submissions and communicate with the BFA or BVwG. This creates structure but does not automatically replace personal duties.

If personal questioning or cooperation is required, it must still be checked what the person concerned must do personally. Representation and personal duties often run in parallel.

Coordinating service and deadlines

The critical question is often when the decision was effectively served. A power of attorney does not fix a deadline that is already running or missed.

The decision, envelope, service proof and all letters should therefore be sent in full. Only then can the open deadline and urgent step be assessed.

Representation when the person is abroad

Many people are no longer in Austria after a return decision or departure. Documents, signatures and questions then need particularly clear organisation.

Readable scans, reliable phone and email details and a short chronology are important. Fewer follow-up questions mean faster legal review.

Important: Authority is only as useful as the documents behind it. Without the decision, service date and contact details, deadline review remains uncertain.
