Entry ban and medical treatment: applying for permission for a specific entry

A medically necessary treatment may qualify as an important private reason for re-entry while an entry ban is still valid. It does not automatically lead to permission. Section 27a FPG requires the specific reason, duration, grounds for the ban and possible refusal grounds to be considered together.

Anyone seeking treatment in Austria should record before applying what treatment is required, when it is scheduled and why it is needed. Permission must be in place before travel and may contain territorial, time-based or other conditions.

How section 27a FPG regulates re-entry during the ban

Section 27a(1) FPG concerns a foreign national who wants to re-enter during the validity of an entry ban and is not subject to a visa requirement. Permission is required for that re-entry.

Under section 27a(2) FPG, the authority may grant permission on application where important public or private reasons make entry necessary, the grounds for the entry ban do not stand in the way and no other visa refusal ground applies. Necessary medical treatment may qualify as an important private reason in these circumstances.

Medical urgency therefore does not create an automatic entitlement. The application should explain the reason precisely and document the treatment so the authority can assess necessity, timing and compatibility with the existing ban. Prove the treatment and travel period with evidence

The medical explanation needs more than a statement that someone is ill. Useful material includes current records, diagnosis, treatment plan, medication overview and confirmation from the treating practice or clinic.

The file should show which treatment is planned, when it is due, how long it is expected to last and why the specific treatment in Austria is required. In an ongoing therapy, the course so far and the consequences of an interruption may also matter.

Clarify the permission period and travel conditions

Section 27a(2) FPG requires the permission to state the objectively appropriate period of validity. The application should therefore connect the planned entry date, treatment period and expected departure in a coherent way.

Under section 27a(3) FPG, the permission may contain conditions. These may include a specific border crossing or route, a restriction of the stay to the district of an administrative authority and regular reporting to a provincial police directorate.

Travel should be organised only after the permission has been read in full and compared with the actual itinerary. A related but separate case is the humanitarian territorially limited visa.

A valid travel document remains a separate requirement

Section 27a(6) FPG provides that the permission is valid only together with a valid travel document. The medical explanation therefore does not replace a valid passport or another permitted travel document.

Before applying and again before departure, check whether the document is valid for the entire planned period and whether entry was requested and permitted with that exact document.

If the passport has expired, is lost or has not yet been issued, that requires separate clarification with the competent authority. Permission must not simply be used with a different or expired document.

Is a medical confirmation enough for permission? +

A medical confirmation is important evidence, but it does not replace the review under section 27a FPG. The entry ban, travel period, travel document and possible refusal grounds must also be considered.

May I enter for treatment while the application is still pending? +

A person within section 27a(1) FPG may not re-enter during the ban without permission. Planned treatment should therefore be clarified through the application and the required evidence before travel.

Can the permission restrict the travel route? +

Yes. Section 27a(3) FPG allows conditions concerning the border crossing, route, permitted area or regular reporting. These requirements should be checked in full before departure.
